Limited Guarantee  

Arti-crete, LLC guarantees that all of the proposed work that is actually done by Arti-crete, LLC will be free of defects in material and workmanship (such as bond failure, flaking, or peeling) for a period of one year commencing from the date of substantial completion of the work. If the purchaser notifies Arti-crete, LLC in writing of a claimed defect within one year of the date that the work was substantially completed, Arti-crete, LLC will, at no charge to the purchaser, remedy all actual defects by, at its option, repairing or replacing the defective work. Leaks, weather, foundation movement or other situations beyond the control of Arti-crete, LLC are not included in this guarantee.

This limited guarantee is subject to the following terms and limitations:

  • Due to the nature of concrete stains are not uniform or predictable in their reaction. Color variances from colors chosen are the norm and therefore are not included in the guarantee. Also, any discolorations that appear after staining and that are due to materials absorbed into the concrete not visible before staining are not included in the guarantee.
  • No repair or replacement by Arti-crete, LLC will extend the life of the original limited guarantee
  • The work must have received normal and routine care and use and must not show signs of neglect, improper maintenance, or mistreatment.
  • Damage or defects (including cracks in the surface coating) caused by movement or settling of soil, concrete or wooden structures is not covered, nor is damage or defects caused by deck drainage.
  • Repair or replacement by persons other than those authorized by Arti-crete, LLC shall void the limited guarantee;
  • All work preformed pursuant to this limited guarantee shall be scheduled at the discretion of Arti-crete, LLC. Arti-crete, LLC. shall not be required to honor this limited guarantee unless the purchaser has paid all amounts due at the time the claim is made;
  • Vapor barriers are a must and Arti-crete is not responsible for moisture or related concerns
  • This limited guarantee is non-transferable

Purchaser’s Representations

  • Purchaser is a record owner of the property on which the work will be done or has a contract with a record owner that permits the purchaser to subcontract with Arti-crete, LLC for the work
  • If the purchaser and Arti-crete, LLC agree in writing to alter plans or specifications for the work, the purchaser will immediately pay any additional charges, unless otherwise agreed, in which case any unpaid balance for extra work done and material furnished shall become a part of the total contract amount.

Purchaser’s Obligations

Purchaser shall:

1. Furnish all electricity and water necessary to complete the work.

  • Remove and replace personal property in the area of the work.
  • Protect the improvements and area of the work from sprinkler damage, pets, vandalism, and traffic of any kind during performance of the work
  • Protect the completed project from work done by other subcontractors.
  • Prior to any work being performed, notify Arti-crete, LLC of any defects or unusual conditions in the area of the work, including but not limited to, areas which may be susceptible to water damage from pressure spray on or around exterior surfaces, doorways, or windows that are not water tight
  • Promptly pay to Arti-crete, LLC, when due, all of the contract amounts in accordance with the payment schedule
  • Pay interest on any past due amount under this contract at the rate of 1.5% per month beginning 30 days after such amount becomes due, until paid in full
  • If purchaser is not a record owner, purchaser shall indemnify Arti-crete, LLC for all loss, cost or expense arising out of claims by a record owner that would otherwise have been limited by the limited guarantee.

Miscellaneous:

  • Arti-crete, LLC shall not be responsible for damage occasioned by the purchaser, the purchaser’s agents or invitees, acts of god, or other causes beyond Arti-crete, LLC control or damage caused by defects not disclosed to Arti-crete, LLC prior to the work being commenced.
  • If purchaser defaults on this contract or fails to perform any of the purchaser’s obligations, then Arti-crete, LLC may terminate the work and may declare all sums due under the contract to be immediately payable. The prevailing party in any action shall be entitled to recover attorney’s fee

Notice of Cancellation

You may cancel this transaction, without any penalty or obligation, within three business days from the date of your down payment. If you cancel, any property traded in, any payments made by you under the contract, and any negotiable instrument executed by you will returned within 10 days following receipt by Arti-crete, LLC, of your cancellation notice, and any security interest arising out of the transaction will be cancelled. If you cancel you must make available to Arti-crete, LLC at your residence, in substantially as good condition as when received, any goods delivered to you under this contract; or you may if you wish, comply with the instructions of Arti-crete, LLC, regarding the return shipment of the goods at its expense and risk. If you do not agree to return the goods to Arti-crete, LLC or if Arti-crete, LLC does not pick them up within 20 days of the date of your notice of cancellation, you may retain or dispose of the goods without any further obligation. If you fail to make the goods available to Arti-crete, LLC, or if you agree to return the goods to Arti-crete, LLC and fail to do so, then you remain liable for performance of all obligations under the contract. If Purchaser cancels this contract after the cancellation period had elapsed and before commencement of construction, the purchaser shall pay Arti-crete, LLC the amount of expenses incurred to that date plus a fee of ten percent (10%) of the contract price.
